These Terms govern your use of SBK Panch (“the App”), the community directory provided by Shree Taluka Borivali Sindhi Brahma Kshatriya Panchayat (“the Panchayat”, “we”, “us”). By creating an account or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. Who may use the App
- The App is for members of the Shree Taluka Borivali Sindhi Brahma Kshatriya Panchayat community and their families.
- You must be 18 or over to hold an account. A parent or guardian may include details of a child in their family entry.
- Accounts are approved by the Panchayat. We may decline or withdraw access at our discretion.
- You may not transfer or share your account with anyone else.
2. Your account
You are responsible for keeping your login details confidential and for everything done through your account. Tell us at once if you believe someone else has gained access to it. You may ask us to close your account at any time by contacting us, and we will do so without asking for a reason.
3. How the directory may and may not be used
The directory exists so that members of one community can stay in touch with one another. Please read this section carefully — it is the heart of these Terms.
You may use member details to contact people personally, for community, family, religious and social purposes.
You may not:
- Use member details for marketing, advertising, promotion or any commercial solicitation.
- Send bulk or unsolicited messages, calls or emails to members.
- Copy, export, scrape, photograph or otherwise extract the directory, in whole or in substantial part.
- Share member details with anyone outside the community, or publish them anywhere.
- Use the directory to raise funds, canvass for votes, or promote a business, product or political cause.
- Use member details for any unlawful purpose, or to harass, intimidate or defraud anyone.
- Attempt to gain access to parts of the App you are not authorised to use, or interfere with its operation.
Breaking these rules is a serious matter. We may suspend or remove your access without notice, and may report unlawful conduct to the authorities.
4. Your directory entry
- Entries are compiled and maintained by the Panchayat. Members view the directory in the App but do not add or edit entries themselves.
- Please tell us whenever your details change, so that the directory stays accurate.
- When you give us details about another person — including a family member — you confirm that you are entitled to share them and that they are aware.
- You grant the Panchayat permission to display your details within the App to other approved members, for as long as your entry remains listed.
- We may correct or remove entries that are inaccurate, duplicated or inappropriate.
5. Privacy
Our Privacy Policy explains what we collect and how we handle it, and forms part of these Terms. Please read it alongside this document.
6. Availability of the App
The App is provided as a service to the community, free of charge. We do our best to keep it running, but we do not promise it will always be available, uninterrupted or free of faults. We may change, suspend or discontinue any part of it, and we may stop supporting older versions.
7. Accuracy of directory information
Directory entries are supplied by members themselves. We do not verify every detail and we are not responsible for information that is wrong, out of date or misleading. If you spot an error, please tell us.
8. Our responsibility to you
The App is provided “as is”. To the extent permitted by law, the Panchayat, its committee members and volunteers are not liable for any indirect or consequential loss arising from your use of the App, or from another member’s conduct. Nothing in these Terms limits liability that cannot be limited by law.
9. Your responsibility to us
If your misuse of the App or breach of these Terms causes a claim against the Panchayat, you agree to cover the reasonable costs and losses that result.
10. Ending your access
You may stop using the App at any time, and you may ask us to close your account and remove your entry. We may suspend or end your access if you break these Terms, if you cease to be a member of the community, or if we discontinue the App. Sections that by their nature should survive — including sections 3, 8 and 9 — continue to apply afterwards.
11. App stores
You obtained the App from the Apple App Store or Google Play. These Terms are between you and the Panchayat only, not with Apple or Google. Neither Apple nor Google is responsible for the App or its content, and neither has any obligation to provide support or to address any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a relevant embargo, and are not on any prohibited-party list. You must also comply with the app store’s own terms of service.
12. Changes to these Terms
We may update these Terms from time to time. We will change the date at the top and, for significant changes, notify you in the App. Continuing to use the App means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute.
